Temphone – Terms of Service

Welcome to Temphone. These Terms of Service (“Terms”) govern your access to and use of Temphone’s applications, website, APIs, and related communication and AI services (“Services”). By creating an account, accessing, or using our Services, you agree to these Terms. If you do not agree, do not use Temphone.

1. Overview of the Service

Temphone provides temporary and long-term virtual phone numbers, VoIP-based messaging, app-based calling, and optional AI-powered features for lawful personal peer-to-peer communication.

Temphone does NOT:
• Function as a traditional mobile carrier.
• Support emergency calling (e.g., 911, 112, 999).
• Support emergency SMS or life-critical services.
• Support international calling.
• Initiate messages to third parties on its own.
• Send marketing or promotional SMS to recipients on your behalf.

You understand and agree:
• All communication is user-initiated, peer-to-peer.
• You—not Temphone—control all message content.
• You are fully responsible for the legality of your use.
• Temphone is not a party to your conversations.

2. Eligibility & Account Requirements

To use Temphone, you must:
• Be at least 13 years old (or the minimum legal age in your region).
• Provide accurate and lawful registration details.
• Maintain secure access to your account.
• Not share or resell your account or purchased numbers.

Verification Requirements:
• Temphone may require identity verification (including government ID).
• Verification may be required at any time to prevent fraud or abuse.
• Failure to complete verification may result in suspension or termination.

3. Number Assignment, Release & Permanent Data Deletion

When activating a Temphone number:
• You receive temporary licensed access—not ownership.
• Numbers may be reclaimed by carriers or regulators.
• Temphone may reassign numbers at any time if required.

When you:
• Cancel your subscription,
• Fail to renew,
• Downgrade your plan,
• Or manually release a number,

Then:
• The number is scheduled for release at the end of the billing cycle.
• All SMS/MMS/call logs tied to that number are permanently deleted.
• Data cannot be restored after deletion.
• Released numbers may be reassigned to new customers without notice.

4. STOP/UNSUBSCRIBE Keywords (Peer-to-Peer Only)

Temphone does NOT send system newsletters, marketing, or broadcast alerts.

However, telecom rules require handling industry-standard keywords.

When a third party texts your Temphone number:
• STOP, END, UNSUBSCRIBE, CANCEL, QUIT

Temphone automatically sends a required compliance response:
“You have successfully been unsubscribed and will no longer receive messages from this number.”

Effects:
• Delivery from your number to that recipient is blocked.
• Only you can unblock communication.
• This applies only to that specific number/recipient pair.

START / UNSTOP
• The person may text START to resume communications.

HELP / INFO
• Temphone sends a required informational message such as:
“This number is operated by a Temphone user. Temphone provides peer-to-peer communication only.”

These responses are legally required and cannot be disabled.

5. Prohibited Use (Strict Enforcement)

You agree NOT to use Temphone for:
• Spam, fraud, scams, phishing, impersonation
• Harassment, threats, abuse, stalking
• Illegal content or activity
• Bypassing platform restrictions (e.g., multi-account verification abuse)
• Marketing campaigns, mass texts, cold outreach, or lead generation
• Bulk messaging of any kind
• Robocalls or automated outreach systems
• High-volume automation using unauthorized scripts or bots
• Selling or reselling Temphone numbers
• Attempting to avoid carrier filtering or fraud detection
• Interfering with Temphone’s systems, APIs, or security

Violations may result in:
• Account suspension or termination
• Number loss
• Data deletion
• Reporting to carriers or law enforcement

6. AI Features (Auto-Pilot, Co-Pilot, Voice Agents)

Temphone offers optional AI features. When enabled, you authorize Temphone to process limited data required to operate those features, including:
• Incoming message content
• Sender metadata
• Recent conversation context
• Contact names, if you grant permission
• Knowledge base text you explicitly enter for the Voice Agent

AI behavior:
• AI does not access data outside Temphone.
• AI cannot send marketing or promotional messages.
• AI does not initiate conversations without your action or mode selection.
• You can disable AI tools at any time.

You are responsible for all AI-generated messages sent on your behalf.

7. APIs

Temphone may provide APIs to send/receive messages programmatically.

By using Temphone’s APIs, you agree:
• To adhere to rate limits and usage rules.
• Not to send bulk, automated, or marketing messages.
• To maintain compliance with telecom regulations.
• That API access may be restricted for violations or suspicious activity.
• That Temphone provides no guaranteed uptime or delivery performance.

Abuse of Temphone APIs may result in termination.

8. Data Retention & Availability

Temphone stores data only as necessary to provide the service.

You acknowledge that:
• Messages older than ~13 months may no longer be available.
• Temporary numbers store no long-term history.
• Released numbers delete all associated data immediately.
• Deleted data cannot be recovered for any reason.

You are responsible for maintaining copies of any data you need.

9. App Store Terms (Apple-Required Language)

When downloading or using Temphone via the Apple App Store:
• Apple is not responsible for support or maintenance of Temphone.
• Apple is not liable for claims, damages, or disputes.
• You must comply with all App Store rules and policies.

10. User Responsibility & Liability Waiver

YOU ARE SOLELY RESPONSIBLE FOR:
• The content you send
• Your compliance with laws and regulations
• How you use Temphone numbers
• Messages sent by AI tools you enable
• All interactions with third parties

TEMPHONE IS NOT LIABLE FOR:
• Actions or communications of users
• Illegal, harmful, or fraudulent behavior
• Message delivery delays or failures
• Carrier filtering or errors
• Data loss due to number expiration
• Damages arising from your misuse

You release Temphone from all claims arising from your use of the service.

11. Termination

Temphone may suspend or terminate your account if:
• You violate any part of these Terms
• Fraud or abuse is suspected
• ID verification fails
• Payment fails
• Regulatory or carrier rules require it

Termination results in:
• Immediate number release
• Immediate and permanent data deletion

12. Warranty Disclaimer

TEMPHONE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND.

We do not guarantee:
• Message delivery or timing
• Uninterrupted service
• Accuracy of information
• Error-free operation
• Uptime or availability
• Prevention of all spam or fraud attempts

You use Temphone at your own risk.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Temphone is not liable for any:
• Indirect, incidental, or consequential damages
• Loss of data or lost profits
• Harassment, fraud, or illegal user behavior
• Carrier outages or filtering
• AI-generated content
• System downtime or service interruptions

Your exclusive remedy is to stop using the service.

These Terms are governed by the laws of the State of Texas, USA.
